You have to be a gaming company, Nintendo is not yet allowing indie developers (Like Rob ) to submit their content to the eShop. According to some devs such as Renegade Kid, it's a pretty long process. Much longer than it is with Apple, Sony, and MS.

Because you have to be a game company to submit a game or "application", I doubt that the eShop takes in games and apps like iTunes does. (For example, there are various copyright-violating games and apps on the iTunes Store that haven't been caught that wouldn't pass Nintendo's better detection system.) Applications on the eShop are especially different, seeing as Nintendo clearly wouldn't want to make a stupid button that makes funny noises to be on their shop for 2 bucks.

@Nintendude-Plenty of crap hits the eShop, Nintendo only looks for errors and glitches, not quality.
