The way the law actually works is that the action would have been otherwise legal had it not been for the age of one of the participants. Two teenagers going at it are legal, even if both are 16, and therefore minors. The issue arises when someone over the age of 21 engages in said actions with someone under the age of 18. Cases involving an 18 year old and a 16 year old engaging in full intercourse is generally ignored in the U.S. because the age gap is hardly large enough to cause an issue, and the ages of 19 and 20 begin to lean further and further towards unacceptable depending on the jurisdiction, and by general consensus, 21 and over is unacceptable when involved with those under 18.

The reason some ages of consent is 16, as you said, is a matter of cultural values being factored into lawmaking. Whether or not 18 is arbitrarily high is a subject of another discussion, as we aren't comparing other ages of consent to this one, just that the age of consent in the U.S. has been set to 18 for a reason.

Continuing from there, Some more intimate details of their relationship needs to be analyzed before any final judgement can be passed anyway. While again, the student legally could not give consent, and the age of said teacher was far past the point where it's "Let it slide" territory, that alone makes it a crime, even if the student consented.

The reason I say these details need to be known is that it a baseline of the type of relationship they had, which determines just how criminal the teacher is. If they were little more than ' buddies', then she's a criminal and that's the end of that. If, and this is a big if, the relationship they shared was that of an average, healthy relationship between lovers, then she's still a criminal, but far less 'guilty' in the sense that this mess would've been avoided if she held off until his next birthday.

Again, the final verdict lies on how healthy the relationship was, at least to me. By the law, she's still a criminal, no ambiguity, but Statutory rape law is in place to not to protect teens from having sex, but rather to protect from less-than-healthy relationships as they are still malleable to what adults say, just to a smaller degree than younger children.

I'm pretty sure I did Carlos, the thing is while the law is in place, some people interpret it differently. Again, the law isn't there to stop teens from having sex, because having been teens themselves, no Judge would ever seriously charge two 16-year olds with Statutory rape on each other.

As for possession of Child Pornography, that's an entirely seperate law with it's own rulings.
